Condemnation proceeding protested by former owner

By EVELYN OUTCAl.T

SARANAC LAKE - Mrs. Elmer Smith, former owner of 17 Virginia St., protested to the village board last night about plans to demolish the house which the village now owns through condemnation proceedings.

It is the first time public objection hos been raised to the renewal program In the French Hill section which the village is carrying on with federal funds obtained under the HUD (Department of Housing and Urban Development) program.

Mrs Smith was told that the matter is now under the jurisdiction of the courts because State Supreme Court Judge Harold Soden hod issued the condemnation order.

Mayor Charles Keough asked Village Manager Gerald Oxford to arrange a meeting for Mrs, Smith with the members of the committee appointed by Judge Soden to act as referee in the case. It is the committee's duty, Oxford said, to look after her rights as well as those of the village.

Members of the committee are Ivan B. Hunt and Philip Feinberg, both Saranac Lake realtors, and Stephen Buzzell, a Saranac Lake attorney.

Mrs. Smith disagreed with the assessment of her former house, saying that the stairs are in perfect condition, no windows are broken, the floors are not buckled but are varnished and in good shape. She said she had had the downstairs boarded up because children had broken into it, and that the plaster may be cracked and the roof may need some repair, but that these are common problems in Saranac Lake after a hard winter.

She denied that the electric system is outdated and the heating system inoperable…
